DataCare Software Licence Agreement
About this agreement
Effective date: 8 October 2026
This End User Licence Agreement (“Agreement”) is between you (“you” or “your”) and DataCare Labs Private Limited (“DataCare Labs”, “we”, “us” or “our”), Pune, India. It applies to the DataCare software products listed in section 1 (the “Software”).
By downloading, installing or using the Software you agree to this Agreement. If you do not agree, do not install or use the Software. If you accept this Agreement on behalf of a company or other organisation, you confirm that you are authorised to do so, and “you” includes that organisation.
1. Software covered
This Agreement applies to:
- Folder Snapshot by DataCare Labs
- Drive Health by DataCare Labs
- HDD Switch by DataCare Labs
- any other DataCare software that refers to this Agreement.
Sections 8 to 10 contain additional terms for individual products.
2. Licence
DataCare Labs grants you a free, non-exclusive, non-transferable licence to install and use the Software on any number of computers, for personal or business purposes. No licence fee is payable. The Software is licensed to you, not sold.
3. Ownership
The Software, including its code, design, interface, report viewer and documentation, and the names “DataCare Labs”, “Folder Snapshot”, “Drive Health” and “HDD Switch” and their logos, are owned by or licensed to DataCare Labs Private Limited and are protected by copyright and trademark law. Third-party components are covered by section 12.
4. Sharing the Software
The official source of the Software is https://www.datacarelabs.com. You may share an unmodified copy of the installer free of charge, together with this Agreement. You may not:
- sell, rent or lease the Software, charge any fee for it, or include it in a paid product or service;
- distribute a modified, repackaged, bundled or re-branded copy of the Software.
5. Restrictions
Except where applicable law expressly allows it, you may not, and may not allow others to:
- reverse engineer, decompile, disassemble or de-obfuscate the Software, or otherwise try to obtain its source code;
- modify, translate or create derivative works of the Software, including the report viewer embedded in reports created by Folder Snapshot;
- remove or change any copyright, licence or trademark notice in the Software, including the maker’s notice in the source code of reports;
- present the Software or its report viewer as your own product (putting your own branding on reports is allowed, see section 8);
- use the DataCare names or logos without written permission;
- bypass any protection in the Software, or use the Software to develop a competing product.
6. Internet connections and updates
The Software runs on your computer. It does not send your files, folders, reports, drive data, serial numbers or settings to DataCare Labs or anyone else. It connects to the internet for two purposes only: a check for updates, and the optional usage statistics described in the next paragraph. The update check contacts www.datacarelabs.com and downloads a small file containing the newest version number. As with any web request, our server receives your IP address and the version of the Software.
Usage statistics are off until you agree when the Software asks, and you can turn them off at any time in its settings. Only while they are on, the Software sends anonymous statistics to apps.datacarelabs.com: a random installation number that stands only for that installation, the Software version and edition, the Windows version and processor type, and coded results of the features you use (for example “scan: 2 drives, all OK”). Our server works out your country from your IP address and does not store the address. Statistics never include file or folder names, drive models or serial numbers, user or computer names, or anything else that identifies you. When you turn statistics off, the Software stops sending and deletes the data stored on our server for that installation; totals that contain no installation number, such as the number of users per day, are kept. When you choose to update, the new installer is downloaded from www.datacarelabs.com and is installed only if its DataCare Labs digital signature and checksum are valid. Updates may change features, system requirements or supported hardware.
7. Storage devices
Some Software reads information from, or sends commands to, storage devices. You are responsible for choosing the correct drive or folder. DataCare Labs does not guarantee that the Software works with every hard disk, SSD, NVMe device, USB enclosure or bridge, SAS host bus adapter, RAID or other storage controller, Windows version or hardware configuration.
8. Folder Snapshot
- Folder Snapshot reads the names, sizes and dates of the files and folders you select. It does not open, copy or upload the files themselves.
- You may put your own name, logo, colours and contact details on reports, and share reports with anyone, including your customers. Reports show only your branding. The source code of each report contains a short notice naming Folder Snapshot by DataCare Labs as the tool that made it; this notice must not be removed.
- The report viewer embedded in each report remains the property of DataCare Labs. You may share reports, but you may not extract, copy, modify or reuse the viewer.
- Reports can contain file and folder names that are personal or confidential. You are responsible for choosing what to include, checking reports before you share them, and protecting them.
- Password-protected reports are encrypted. DataCare Labs does not keep passwords and cannot open or recover a report if its password is lost.
9. Drive Health
- Drive Health runs with administrator rights, starts with Windows, and keeps a history of drive readings on your computer.
- It shows SMART attributes, temperatures, health ratings and warnings for information and diagnosis. A “Healthy”, “Good” or similar rating does not guarantee that a drive will not fail, and a drive can fail without any warning. Keep backups of important data.
10. HDD Switch
- HDD Switch sends power commands (spin down and spin up) to the drives you select, using administrator rights.
- Check the selected drive before each command and close programs that are using it. Spinning down a drive that is in use can interrupt programs and file transfers. Drives, controllers, enclosures and bridges do not all respond to these commands in the same way.
11. Backups and data recovery
The Software is not a substitute for backups, for professional data recovery or for the manufacturer’s service. Keep current backups of important data before you use any software that works with storage devices. The Software does not recover lost, deleted or damaged data unless a product expressly says that it does.
12. Third-party components
The Software includes third-party components that are licensed under their own licences, which apply to those components instead of this Agreement. In particular:
- Drive Health includes smartctl from smartmontools, unmodified, under the GNU General Public License version 2 or later. The licence text is installed with Drive Health. The source code is available at https://www.smartmontools.org and from DataCare Labs on request (support@datacarelabs.com).
- Drive Health uses Microsoft Edge WebView2 and the Barlow Condensed, Inter and JetBrains Mono fonts (SIL Open Font License 1.1).
- Folder Snapshot and HDD Switch include the Microsoft .NET runtime (MIT licence).
- HDD Switch uses Material Design Icons (Apache License 2.0).
Section 5 does not limit your rights under these licences.
13. Donations and support
Donations, such as to the Support Village Education initiative, are voluntary. They do not change this Agreement or create any right to support. DataCare Labs may offer help at support@datacarelabs.com but is not obliged to provide support, maintenance or updates, and may change, suspend or discontinue any Software or feature.
14. No warranty
To the maximum extent permitted by law, the Software is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. DataCare Labs does not warrant that the Software will be error-free, work without interruption, work with every hardware configuration, detect every drive problem, or prevent data loss or hardware failure.
15. Limitation of liability
To the maximum extent permitted by law, DataCare Labs is not liable for any loss of data, hardware damage, loss of profits or business, or any indirect, incidental, special or consequential damages arising from the use of, or inability to use, the Software or anything it creates. DataCare Labs’ total liability for any claim relating to the Software is limited to the amount you paid for it, which is nothing for free Software. Nothing in this Agreement limits any liability or excludes any right that cannot be limited or excluded by law.
16. Termination
This licence ends automatically if you materially break this Agreement. You must then stop using the Software and delete all copies.
17. Changes to this Agreement
DataCare Labs may update this Agreement. The version published at https://www.datacarelabs.com/software-eula/ applies to new downloads and to updates installed after its effective date.
18. General
If any part of this Agreement is found to be unenforceable, the rest remains in effect. This Agreement is the entire agreement between you and DataCare Labs about the Software.
19. Governing law
This Agreement is governed by the laws of India. The courts at Pune, Maharashtra have jurisdiction, subject to any consumer rights that cannot be excluded by law.
